General terms and conditions of contracting

This contractual document will govern the hiring of accommodation reservations offered through the website www.hotelcasa1800granada.com, owned by GRABENA 1800 S.L., under the commercial brand Hotel Casa 1800 Granada, whose contact details are also listed in the Legal Notice of this website.

These conditions will remain published on the website available to the USER to reproduce and save them as confirmation of the contract, and may be modified at any time by HOTEL CASA 1800 GRANADA, so it is the user’s responsibility to save a copy, as HOTEL CASA 1800 GRANADA will not retain any. It is the USER’s responsibility to periodically read them, as those in force at the time of placing orders will be applicable.

Contracts will not be subject to any formality except in the cases expressly stated in the Civil and Commercial Codes and in this or other special laws. The acceptance of this document implies that the USER:

And on the other hand, the USER who acquires a reservation on the website is responsible for the accuracy of the personal data provided to HOTEL CASA 1800 GRANADA.

Object of the contract.

The purpose of this contract is to regulate the contractual relationship between HOTEL CASA 1800 GRANADA and the USER at the moment when the USER accepts, during the online booking process, the reservation service offered.

The contractual reservation relationship involves the use of chosen room categories (and other extras), for a limited time, in exchange for a predetermined price publicly displayed on the website (when selecting dates and users, the current amounts will be shown). Depending on the required needs, you may purchase extras offered by HOTEL CASA 1800 GRANADA (to be detailed in the purchasing process or to be contracted at the establishment itself).

Hiring procedure.

The USER, in order to access the services or products offered by HOTEL CASA 1800 GRANADA on this website, must be of legal age. For the provision of the service and reservation, the USER must provide personal data freely and voluntarily, which will be treated in accordance with the provisions of Regulation (EU) 2016/679, of 27 April (GDPR), and Organic Law 3/2018, of 5 December (LOPDGDD), detailed in the Legal Notice and Privacy Policy of this website.

Right of withdrawal:

In accordance with article 103. l) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users, the right of withdrawal shall not apply to contracts referring to the provision of accommodation services for purposes other than serving as housing, food, or services related to leisure activities, if the contracts provide for a specific date or period of execution; therefore, if the User unilaterally cancels the contract, they shall not be entitled to a refund of the amount paid as a reservation, notwithstanding that HOTEL CASA 1800 GRANADA may voluntarily offer free cancellation or the option to modify their reservation for other dates. In the event of resolution or breach of the contract, the amount and method of payment refund during the contract term will be paid as agreed by the parties.

Cancellations and modifications:

5. FORCE MAJEURE.

The parties will not incur liability for any failure due to force majeure. The fulfillment of the obligation will be delayed until the cessation of the force majeure event.

6. COMPETITION.

The USER may not assign, transfer or transmit the rights, responsibilities and obligations contracted. If any provision of these terms is deemed null or impossible to comply with, the validity, legality, and compliance of the rest will not be affected in any way, nor will they undergo any modification. The USER declares to have read, understood, and accepted these General Terms and Conditions in their entirety.

7. GENERALITIES OF THE OFFER.

The details of each reservation are informed to the USER in their respective description on the website. All reservations made by Hotel Casa 1800 GRANADA will be subject to the following General Conditions. No modification, alteration, or agreement contrary to the Commercial Proposal of Hotel Casa 1800 GRANADA or stipulated here will have effect, unless expressly agreed in writing and signed by Hotel Casa 1800 GRANADA, in which case, these particular agreements will prevail. Given the continuous technical advances and improvements of services, Hotel Casa 1800 GRANADA reserves the right to modify its specifications regarding the information provided in its advertising, as long as it does not affect the value of the services offered. These modifications will also be valid in case, for any reason, the possibility of providing the services offered is affected. Important: due to the historical nature of the house, the rooms are different from each other. Not all rooms of the house have been published. Rooms of the same category may be distributed differently.

Entries and exits:

Check-in: The check-in time for reserved rooms is from 3:00 pm (local hotel time). If you arrive earlier, you can leave your belongings in the luggage storage

Check-out: The check-out time for rooms is until 12:00h (local hotel time), and guests must leave the keys at the front desk. If needed, guests can store their belongings in the luggage storage (please inquire at the front desk).

Customer responsibilities.

All USERS must make proper use of the website and our facilities, becoming solely responsible for any damage or harm that may be caused to HOTEL CASA 1800 GRANADA or third parties due to lack of diligence or malicious actions. Any inappropriate, violent, disturbing, or illegal behavior may give HOTEL CASA 1800 GRANADA the right to expel USERS from our accommodation, without the right to future claims or any kind of reimbursement.
Minors must be accompanied at all times, absolving HOTEL CASA 1800 GRANADA of any responsibility for accidents or damages caused by unsupervised children.

The USER will be responsible for their personal belongings at all times. In this sense, any direct or indirect damages caused by third parties of any kind:
Losses, thefts, or damages to guests' belongings whether in the rooms, common areas, or parking lot, will not be the responsibility of HOTEL CASA 1800 GRANADA.
However, we have available for guests our internal regulations which can be requested at the reception.

8. PRICE AND VALIDITY PERIOD OF THE OFFER.

The prices indicated for each reservation include Value Added Tax (VAT). These prices, unless otherwise expressly stated, do not include tourist taxes, travel insurance or any other additional services and annexes to the service purchased.

The applicable prices are those published on the website and will be expressed in the currency EURO by default, with the option to configure the currency from the available options. The USER understands that the economic assessment of some services may vary in real time. Prices can change daily at any time until a reservation is made.

Every payment made to Hotel Casa 1800 GRANADA implies the issuance of an invoice with the consent (art. 63.3 RD 1/2007) in the name of the registered USER or the business name provided at the time of placing the order. This invoice will be handed to the USER when the rental ends and the payment for the contracted services is made. The invoice will be provided on paper upon departure. If you wish to receive it via email, you must request it through any of the means that Hotel Casa 1800 GRANADA provides, and indicate that you may revoke this decision at any time.

9. BOOKING/PURCHASING PROCESS.

To make a room reservation on our website, you must follow these steps:

Choose the arrival date, the number of nights, the number of rooms, and the occupants.
Select the type of room: the customer can choose from the different options of rooms available, depending on the availability for the selected dates.
Select the desired rate and regime: there are different rate options and promotions that are activated depending on the dates, as a series of restrictions are applied to each one (advance booking, minimum stay, etc.). 10. DISSOCIATION AND SUSPENSION OR TERMINATION OF THE CONTRACT.

If any of these terms and conditions are deemed illegal, void, or for any reason unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. Hotel Casa 1800 GRANADA may, without prior notice, suspend or terminate the USER’s access to its services, in whole or in part, for any valid reason, including, without limitation, when the USER fails to comply with or follow any of the obligations established in this document or any applicable legal provision, license, regulation, directive, code of practice, or usage policies. When Hotel Casa 1800 GRANADA exercises any of its rights or powers under this Clause, such exercise shall not prejudice or affect the exercise of any other rights, powers, or remedies that may be available to Hotel Casa 1800 GRANADA.

11. APPLICABLE LAW AND JURISDICTION.

These conditions will be governed or interpreted in accordance with Spanish legislation in those aspects which are not expressly established. HOTEL CASA 1800 GRANADA and the USER agree to submit to the courts and tribunals of the hotel’s domicile for any dispute that may arise from the provision of the products or services covered by these Conditions.
